I work in fast food part-time. One day one of the younger cashiers
went to the assistant manager to complain that for the past two weeks
one of the dishwasher guys had been spontaneously grabbing and
“hugging” her whenever she had to go in the back for stock, and he’d
try to cop a feel under the guise of the hug. The assistant manager
said “You mean this kind of hug? Or this kind? Or this way?” and
proceeded to hug/grab the cashier. The third time he actually touched
her breasts. The cashier was so shocked she ran out of the store
crying. The assistant manager saw me standing there dumbfounded and
said “You didn’t see a damn thing” and walked away.
The next day the regional owner walked in, took the assistant manager
outside for a talk, and then the owner came back in and asked me
“Exactly what is it he swears you didn’t see?”
Other than him fondling the UNDERAGE cashier and refusing to deal
with the dishwasher who’d been harassing her for weeks? Other than
that, not a thing.
The regional owner went in the back, asked the dishwasher to step
outside with him to where the assistant manager was waiting, and we
didn’t see the three of them again that night, and never saw the
dishwasher or assistant manager again. Amazingly, the cashier didn’t
sue.

Why sue? They got fired. She probably couldn’t have won anything anyway BECAUSE they got fired. It’s not like upper management condoned this sort of thing and didn’t do anything about it. Man, you can’t sue for just anything ya know. I know, it seems like it, people suing because their feelings are hurt. But more of them lose.
You’re right, George. The law says management can’t ignore a sexual harassment complaint. It wasn’t ignored, it was handled by the book.

You ask why not sue? Because getting fired doesn’t make it even. This is just a disciplinary action, and law was not served. The OP still could go to the police station and fill a report.
I kill a co worker. I get fired. No need to sue isn’t it?

It’s a bit unclear, but good for you for telling the truth and not enabling further abuse.
George is right, you can’t sue if the company took corrective action. The RM did the right thing by letting both of those guys go. If he had not done that or reprimanded them severely, then the girl would have had right to sue and the RM would be seen by the law as an accomplice. Managers have a legal duty to address the situation with punishment or termination when sexual harassment is done. If the AM had not committed his own crime, and simply let the dishwasher off, then he would still be in just as much trouble as when he groped the girl.
Maybe not sue the company, but she could definitely sue the person/s
She could sue the former manager and dishwasher, but not the company. The company acted swiftly and decisively, and didn’t create any kind of ‘culture of tolerance’ for that sort of behavior. On the other hand if she was underage, those two former employees now have a new set of legal matters on their hands…
@emilyG – Any good lawyer will tell you you never sue the person who harassed you. The company is the one with the money.
God I hate girls like this.
For some reason, they feel that their comfort is more important than other people’s jobs. Rather than dealing with the issue there and then (slapping the guy, telling him off, etc.) she runs out and creates a huge problem. Two more unemployed people because one girl felt uncomfortable.

the company, acted within the law and swiftly and therefore not at fault and most likely, if it went to court, would not be found guilty or forced to make a payout.
the other two men could, and should be jailed…

Yeah Cam, I’m totally with you. I mean, what girl has the right to not have to work where she’s fondled every day, and where, when she complains, gets assaulted again? Why shouldn’t she slap her coworker or boss and get charged with assault?
If her boss wasn’t such a jerk and had dealt with the problem appropriately, no-one would have lost their jobs. Blame the teenaged girl, though, since it makes you feel like a big man. You probably blame rape victims too, for ruining a guy’s fun.

If I was so insecure and afraid as to let it go on that long and then the manager started doing it- I’d not say a word and start recording it and get myself a seriously ruthless lawyer to drain that company of everything.
But in light of Jeff’s comment it would be personally satisfying to have those guys fired and jobless- then again if there was no court case they would not be publicly humiliated. Just jobless. She was a minor though- so sexually assaulting her could get them on a list so others would be warned. So If I were her/her parents and thought about suing it would be a hard toss up.
I think sexually assaulting a minor ( teenager are pretty much children mentally, that’s why we have laws to protect them) is worth stiffer punishment than somebody just losing their job. I think we all agree Cam is a jagoff.
