Sorry For Your Losses

I was informed my father had passed away and I wrote my boss and his
deputy (located in an office in another state) that I would be at
work that day – but would be out the following week for bereavement
leave as I had to travel to another state for the funeral.

The deputy e-mailed his condolences later that morning, and my boss
called me later that morning at my office to express his condolences
and inform me I was being terminated, but he was willing to grant me
bereavement leave for the following week if I really needed the time
off.

Like Dad used to say, some days you have to laugh to keep from
crying.

  3. Is this even legal?

  5. What are you for real, where do you work, they can do that?

  7. I’d have to suggest you consult an attorney after the funeral. the timing on this screams “retaliatory”

  9. What your boss did is illegal. Consult an attorney ASAP

  11. Boss didn’t do anything illegal. We really don’t have enough information to determine whether the termination came as a result of the requesting a week of bereavement, or whether they were planning to terminate the OP anyway, and the timing just happened to fall on this day.

  13. O give me a damn break….your telling me he just HAPPENED to be going to fire him that day…bullshit if I ever heard it…

  14. MagnoliaGirl on May 31st, 2010
  15. And I thought that me being fired on the day I got a kidney stone because I asked that they start my health ins because they were a week behind on giving it too me.

  17. No, I’m saying that they might have planned on terminating them and decided that it would just be better to tell them at that point (get all the bad news over in one shot) than wait until the OP got back and then add further stress.

  19. Billy has a point….and if he is correct in his thinking, then the boss was actually doing the guy a favor by giving him his one week bereavement which would be paid(maybe) before he was officially fired.

  21. Something like this happened to a friend of mine.He was let go just after returning from a medical leave (downsizing unrelated to his medical leave). but was then allowed to take his accrues vacation and additional medical leave before being terminated.

  23. It’s not illegal. Virtually all states in the US are employment-at-will states; meaning, in the absence of employment contracts, employers generally may fire employees for any reasons, no reasons and even unfair reasons, as long as they are not illegal reasons.

That being said, it wasn’t the best of times to be let go. Sorry.

  25. i’m very sorry for your loss. What a crappy day that must have been.

  26. Hanna on June 15th, 2010
  27. BULLSHIT! It was very stupid of them to do it then, they can SO be sued for that! Has he never HEARD of attorneys??? Anyone with half a brain would have waited until they couldn’t say it was because of the death. DERP!

  29. Stupidity, insensitivity, and bad timing are not in themselves illegal.

But karma has a ferocious bite.

  31. The fact that they granted you bereavement leave suggests that there was another reason for terminating you. If it were retaliatory then they wouldn’t have granted you bereavement leave (which they’re not actually required to do – they only have to give you the day of the funeral itself off).
